A Vendors statement or Section 32 is a document provided to any potential purchaser(s) before they make an offer on a property.   

It provides information that one would not be able to obtain by merely inspecting the property.

The Section 32 document provides information such as:

  • Who own the property
  • Mortgages – Does a financial institution hold rights over the property
  • Covenants – Agreements that require the property owner to do or refrain from doing something.  For example, only one dwelling is permitted on the land
  • Easements – Provides rights for another entity to use the land, including drainage and sewerage pipes.
  • Zoning – How the council will allow the land to be used
  • Outgoing of rates –  Including; council rates, water rates, owners corporation fees, rent
  • Declarations if located in a bushfire prone area

It is important for potential purchasers to note that the Vendors Statement does not provide information on the condition of the building or the accuracy of the measurements on title.
